§ 28-6. Discharge of firearms in proximity to schools.

  • (a)

    Except for law enforcement officials and military personnel in the performance of their duties, a person acting in the defense of himself or others, a person operating a "shooting range" or "range" as the terms "person," "shooting range" and "range" are defined in S.C. Code 1976, § 31-18-20, as amended, it is unlawful for any person to discharge a firearm within 300 feet of any property line of any public or private elementary, middle, or secondary school, public vocational or trade school or technical education center, public or private college or university, or any "childcare facility" as that term is defined in S.C. Code 1976, § 20-7-2700 b., as amended.

    (b)

    Any person violating this section shall be guilty of a misdemeanor and, upon conviction, must be fined not more than $500.00 dollars or imprisoned for not more than 30 days.
