§ 28-5. Resisting lawful arrest.

  • (a)

    It shall be unlawful for any person who has lawfully been placed under arrest to evade, oppose, resist, hinder, run or impede any law enforcement officer from making such lawful arrest.

    (b)

    It shall be unlawful for any person to knowingly and willfully fail or refuse to stop when signaled, hailed or commanded to stop by a law enforcement officer if such law enforcement officer has a warrant for the arrest of such person, or has a reasonable suspicion that such person is about to commit a crime, is in the process of committing a crime, or has committed a crime.

    (c)

    A "law enforcement officer" shall mean any duly appointed or commissioned law enforcement officer of the state or county.

    (d)

    Any person who violates the provisions of this section shall be deemed guilty of a misdemeanor and, upon conviction, be fined not more than $500.00 or imprisoned for not more than 30 days, or both.
