§ 6-53. Injunctions, fees and penalties.

  • (a)

    Any person who shall violate the requirements of this article or who shall fail to comply therewith, in the performance of work under the county building code, shall be guilty of a misdemeanor. Each person shall be deemed guilty of a separate offense for each and every occasion of violation and for each and every day or portion thereof during which any violation of the provisions of this article is committed or continued. Upon conviction of this violation of this article, the person thus convicted shall be punished by a fine of not more than $200.00 or imprisonment for a term of not more than 30 days for each offense.

    (b)

    A contractor of any license classification, as defined herein, who does not have appropriate license and/or valid building permit as required herein and/or under the building code, as adopted, may not bring any action either at law or in equity within the jurisdiction of the county to enforce the provisions of any contract for such work under the building code of the county or of any part thereof, which he entered into in violation of this article, the building code and/or any part thereof.

    (c)

    The building official of the county is responsible to administer the requirements of this article except as may be assigned as the responsibility of the board, and shall collect such fees as are herein prescribed, and shall develop such forms, applications and other documents, reports or systems with the approval of the board, as are required and necessary to administer this article and to enforce the requirements herein provided.

    (d)

    Fees required for examination and/or license issue within any single license classification shall be:

    (e)

    Refunds shall be made only for initial license issue fee set forth in subsection (d) of this section wherein the licensing fee has been paid and subsequently, the license has been denied by the board prior to issue of said license.
