§ 38-226. Standards.

  • (a)

    New roads must meet the standards of the county subdivision ordinance.

    (b)

    The following standards shall apply to existing roads:

    (1)

    No road shall be maintained by the county unless it is bordered by a minimum of two landowners and/or is bordered by their heirs' property with a minimum of two dwellings on the same parcel.

    (2)

    Except as to roads dedicated to the county as a matter of law, roads meeting the criteria of subsection (b)(1) of this section may be maintained by the county upon petition of all such landowners and upon acceptance of such petition by the county council. Prior to the acceptance of such petition, however, the public works department shall inspect the road proposed for maintenance to ensure that it is constructed of stabilized aggregate base course eight inches uniform thickness, without surfacing, said base course to be a minimum of 20 feet in width, together with adequate ditch sections. Following such acceptance by county council, all landowners must execute an appropriate easement of such width as required by the public works department to enable the county to maintain the roadway as it exists.
