§ 38-3. Regulation of roadway connections to county streets and roads.

  • With respect to streets and roads under the jurisdiction of Dorchester County, and with the reasonable exercise of the police power, Dorchester County is hereby authorized and empowered to:

    (a)

    Regulate the connection of new and/or existing streets or roadways not controlled by the county, by private and public entities, or individuals, to roadways and streets under the jurisdiction of the county based on the following criteria:

    (1)

    Increased traffic volumes of receiving county roadways or streets;

    (2)

    Traffic study of the surrounding roadway network;

    (3)

    Pedestrian connectivity;

    (4)

    Existing conditions of adjacent roadways and infrastructure;

    (5)

    Public input;

    (6)

    Consideration of any hardship, safety, or nuisance to owners of property that may be affected by such connectivity;

    (7)

    Proposed improvements to be constructed by the entity or individual seeking such connectivity to reduce the above impacts;

    (8)

    Evidence of coordination by the municipality approving such development with the county to reduce potential impacts to existing streets and roadways with the jurisdiction of the county.

    (b)

    A request for such connectivity addressing each of the criteria set out above shall first be made to the Dorchester County Planning Department which shall make recommendation to the county council.
