§ 34-1. Maintenance of portable disposal containers.

  • (a)

    Portable disposal containers shall be used for the disposal of residential waste and said waste must be placed inside the container at the container site and not on the ground. All other waste, appliances, industrial waste, trees or brush, etc., must be disposed of at a DHEC-approved landfill.

    (b)

    No person shall search, probe, scavenge, damage or remove any portable disposal container from its designated area.

    (c)

    Nonresidents of the county shall not be permitted to use any portable landfill container.

    (d)

    The area leased or owned by the county for the use of the disposal container sites is for the sole and exclusive purpose of disposal of acceptable residential waste and recyclables. Any use of the area which is not associated with the disposal of residential waste is prohibited. Any person using the area for any inconsistent purpose shall be deemed a trespasser. No person shall go upon, be upon, or remain upon the above-named areas except when being engaged in the actual procedure of disposing of residential waste as defined by this article. Any person going upon, being upon or remaining without being engaged in the actual procedure of disposing of residential waste shall be deemed a trespasser and shall be punished in accordance with the provisions of this article.

    (e)

    Any person violating the provisions of any rules and regulations prescribed by this article shall be deemed guilty of a misdemeanor.

    (f)

    All law enforcement officers in the county are called upon and empowered to enforce the provisions of this article.
